You're side job outside of school has ZERO reflection on who you are and your character as a person and should have no bearing or impact on the Administration or Sec of Education wildly speculating about your ability to do a job because of a second profession/job you have.

There is a MASSIVE move right now with 10+ lawsuits involving teachers in the US where the school district has fired their teachers over the fact it is discovered their Teachers have an Only Fans acct where they are producing and posting Adult Sex Themed content and publishing it to Only Fans and making tons of money doing it.

Schools are firing these teachers as they are uncovered. HOWEVER, Legally they are starting to challenge this....can a teach be fired for having an Only Fans acct they post adult content to?

Ultimately I think the Legal side of this will be tied into the Only Fans type lawsuits where the teachers are being fired. Can a Public Teacher hold a job and make money in an Adult Themed Profession while still being a successful educator for children?

Shane Murnan was charged in Payne County by DA Rob Hudson's office. Rob Hudson is now on the Oklahoma Court of Criminal Appeals. I know Rob. I've worked with Rob Hudson in various positions at various times for probably 15 years now. He is about as far from a liberal as you can get.

The charges were filed 20 years ago. They were dismissed on the basis (stated in the motion to dismiss) that "COURT FINDS NO EVIDENCE OF CRIME".

The case was subsequently expunged pursuant to 22 OS 18 and 19. Sections G through I state the following:

G. Upon the entry of an order to seal the records, or any part thereof, or upon an automatic expungement described in subsection B of this section, the subject official actions shall be deemed never to have occurred, and the person in interest and all criminal justice agencies may properly reply, upon any inquiry in the matter, that no such action ever occurred and that no such record exists with respect to such person.

H. Inspection of the records included in the order may thereafter be permitted by the court only upon petition by the person in interest who is the subject of such records, the Attorney General, or by the prosecuting agency and only to those persons and for such purposes named in such petition.

I. Employers, educational institutions, state and local government agencies, officials, and employees shall not, in any application or interview or otherwise, require an applicant to disclose any information contained in sealed records. An applicant need not, in answer to any question concerning arrest and criminal records, provide information that has been sealed, including any reference to or information concerning such sealed information and may state that no such action has ever occurred. Such an application may not be denied solely because of the refusal of the applicant to disclose arrest and criminal records information that has been sealed. (Emphasis mine)

IF the school district has REFUSED to hire him for a charge that was dismissed and subsequently expunged pursuant to 22 OS 18/19....if they took it into consideration in their hiring decisions.....if they even asked him about it in a job application...if they dismissed him after finding out about those expunged charges....they would have been violating Oklahoma law and subjecting themselves to a really strong lawsuit.

If he's going to go after him at all, he HAS to go after him for being a drag queen only....and let his mindless minions go after him for the charges that were dismissed and expunged pursuant to 22 OS 18 and 19.

He'd be violating Oklahoma law if he went after him in any way for the expunged charges. The school system would have been violating Oklahoma law if they refused to hire him, fired him, or even asked him about charges expunged pursuant to 22 OS 18 and 19.

That’s a lot of meaningless typing. None of it changes the fact the Superintendent was quoted as saying he knew about the charges. We are talking about an ELEMENTARY school position. It is very fair to be concerned hiring someone to be around young people each and every day that has a credible charge of child pornography.
I hope Murman finds a great job, I hope he leads a great life…but hiring him for position being around elementary aged students is neither wise..nor is it considering the needs of families and patrons of the district.

Judge Dave Allen said at the time of the charges that it was “clear from review of the pictures that it was child pornography”. The Stillwater Superintendent said at the time of the charges “we have reason to believe there is a problem”.

I hope Murman finds a great job, I hope he leads a great life…but hiring him for position being around elementary aged students is neither wise..nor is it considering the needs of families and patrons of the district.

The law REQUIRES that he treat and deem it as to have never happened.

No other charges ever filed.

All law that says the expunged charges have to be treated as if they never happened.
