What this judge fully understands is that he won't have to make any kind of a decision if he pushes deciding out past next Tuesday.

Our court system just doesn't understand that timelininess is important sometimes.
In order to grant a temporary restraining order against this conduct, the court would have to find:
-likelihood of success on the merits
-immediate, substantial, and irreparable harm will result to the person seeking the order before a full adversary hearing can be held on the propriety of a preliminary or final injunction
It may not be popular to say this here, but I'm not sure a judge could make such a ruling in this case at this point. If I was the State judge, I'd probably do the same thing as he is.
