The difference is the split for his Senate seat is <30k votes and 0.4% difference with provisional votes still being counted not needing to flip several states.

Doing it once gets him two years in the office. Then they can do it again.
Or Trump will just name him as "Acting AG" and never bother to get him approved by the Senate....he's done that.

Because head of a department is a single position. It could be head and deputy though which would warrant two people.
