Elon Musk individually does not qualify as a "civilian population".

Furthermore, so far the violence and criminal conduct has been property damage that has posed no acts dangerous to human life.

Until the criminal conduct poses a danger to human life....and so far, there is absolutely no evidence that it has because it has all been property damage....you don't even get into the discussion of whether or not i, ii, or iii is applicable.

Acts of violence is a VERY broad term.

If they commit a federal crime, they should be prosecuted at the federal level.

If they create an act of domestic terrorism as defined by statute, they should be prosecuted for that.

I also want to make it clear that I am not supporting, encouraging, downplaying or excusing any criminal conduct committed.

I’m just pointing out that the reports of the conduct so far don’t meet the statutory definition of domestic terrorism.

Yes, by definition, they are.
I would say that some of them were….primarily those charged and convicted of insurrection.

A lot of them, however, were simply criminals…some felons and some misdemeanants.
