If they commit a federal crime, they should be prosecuted at the federal level.
If they create an act of domestic terrorism as defined by statute, they should be prosecuted for that.
I also want to make it clear that I am not supporting, encouraging, downplaying or excusing any criminal conduct committed.
I’m just pointing out that the reports of the conduct so far don’t meet the statutory definition of domestic terrorism.

I would say that some of them were….primarily those charged and convicted of insurrection.
A lot of them, however, were simply criminals…some felons and some misdemeanants.
No. Not with any legal effect to speak of.
I mean he declare whatever the eff he wants, but he has to ultimately prove it beyond a reasonable doubt in court.
