Judge finds probable cause to hold Trump administration in contempt for violating deportation order

A federal judge on Wednesday said he has found probable cause to hold President Donald Trump’s administration in criminal contempt of court for violating his orders to turn around planes carrying deportees to El Salvador.

U.S. District Judge James E. Boasberg said the administration must try to “purge” itself of a contempt finding, or he will launch hearings and potentially refer the matter for prosecution. “The Court does not reach such conclusion lightly or hastily; indeed, it has given Defendants ample opportunity to rectify or explain their actions. None of their responses has been satisfactory,” the judge wrote.
 

Children of Active Duty US Soldiers push back on Pete Hegseth With a Lawsuit Over Book Removals in Dept of Defense on base School Libraries​

The kids are located on Bases in the US, Japan and Italy and range from Preschool to High School aged

Defense Secretary Pete Hegseth is being sued by 12 students over the removal books on race and gender from Pentagon schools following an executive order from President Donald Trump.

The lawsuit, filed on the students’ behalf by the American Civil Liberties Union, alleges that their First Amendment rights are being infringed by the decision, which they argue places children in danger by depriving them of important information about health, hygiene, biology, and abuse.


Emerson Sykes, ACLU’s lead counsel in the case, said in a filing: “The quality of children’s education, their exposure to ideas and the preparing of citizens in the next generation are all being harmed by this censorship.”

“This is not how public schools are supposed to work—students have a right to learn and to access information that should be above the political fray.”

The plaintiffs attend schools run by the Defense Department both in the U.S. and overseas, which are classified as civilian schools and subject to First Amendment rights. The 12 children belong to five families of active duty personnel based in the U.S., Italy, and Japan, with their ages ranging from pre-kindergarten to high school.

The Department of Defense Education Activity serves about 67,000 children of both active-duty and civilian personnel in the U.S. military around the world.


Since taking office, Trump has signed a number of executive orders aimed at dismantling diversity, equality, and inclusion (DEI) initiatives, which have been aggressively pursued by Hegseth at the Department of Defense.

The defense secretary has used two in particular, Defending Women from Gender Ideology Extremism and Ending Radical Indoctrination in K-12 Schooling, to purge nearly 400 books from the Naval Academy Library and enforce Trump anti-DEI policies at other Pentagon schools.

Included in the purge was Maya Angelou’s I Know Why the Caged Bird Sings and Janet Jacobs’ Memorializing the Holocaust, which examines the way in which female victims of Nazi Germany are remembered, The New York Times reports.

Linda Gordon’s The Second Coming of the KKK was also removed, but Hitler’s Mein Kampf was not, and neither was The Bell Curve, which claims Black people are genetically less intelligent than white people. (A critique of the book was among the banned texts.)


In Japan, the award-winning Queer History of the United States was pulled from school shelves, despite it being a core text in AP Psychology courses, while in Italy a children’s book titled Julian Is a Mermaid was among 25 titles removed by the DoD.

“By quarantining library books and whitewashing curricula in its civilian schools, the Department of Defense Education Activity is violating students’ First Amendment rights,” Matt Callahan, senior supervising attorney at the ACLU of Virginia, said in an ACLU press release. “The government can’t scrub references to race and gender from public school libraries and classrooms just because the Trump administration doesn’t like certain viewpoints on those topics.”


Corey Shapiro, legal director for the ACLU of Kentucky, added in the relase: “Our clients have a right to receive an education that includes an open and honest dialogue about America’s history. Censoring books and canceling assignments about the contributions of Black Americans is not only wrong, but antithetical to our First Amendment rights.”


In addition to Hegseth, Beth Schiavino-Narvaez, the head of the Pentagon school system, has been named as a defendant in the lawsuit.

The Department of Defense declined to comment to the Daily Beast, saying it does not comment on ongoing litigation. The Daily Beast has reached out to Hegseth’s attorney for comment.
 
Schools get grants for research and development, its not just free money. The school best positioned to make progress should be getting those grants regardless if they are public or private universities because the government is paying for the research to be done.

If a public university can do the same work to the same level as a private, maybe then you give the grant to the public one.

Meritocracy, I love it. Yes, choosing the best applicant for the grant make sense..agree.

That said, Oklahoma public universities are getting a mere fraction of what just Harvard receives. By granting Harvard, and other Ivy League schools, such a disparity in federal dollars…it makes it difficult for Oklahoma public schools to compete…for both funding and faculty. Because of the historical funding disparity, OSU/OU lack the resume for grants and must pay premiums to get top researchers to join their school.
(Sorry, my work on school boards and my close work with a CFO of a SEC school gives me a good perspective of this catch-22 issue….and certainly influences my bias to get more research dollars to public universities)

If you want to argue that schools shouldn't be in the research business or should be funded purely by private donation, then I guess we can have that conversation but that is not what this is really about.
No i am not arguing that at all. University research provides a tremendous benefit to the country.

This a complete shift and unrelated to the conversation but I just wanted to point something out.

Replace OU and OSU with minorities and Harvard and other I've league with white men...That is nearly the exact reasoning behind affirmative action but applied to schools vs people.

Im not arguing for Harvard to get everything or nothing. I believe you need to diversify who is doing the work and push schools to cooperate and bring the less established schools along.
 
'Homegrowns are next': Trump hopes to deport and jail U.S. citizens abroad NPR

President Trump says his administration is actively exploring a proposal to detain U.S. citizens and send them to prisons in El Salvador. Speaking Monday, minutes before a press briefing alongside El Salvador's President Nayib Bukele, Trump could be heard embracing the concept.

"The homegrowns are next, the homegrowns. You've got to build about five more places," Trump said to Bukele, an apparent reference to prison space that would be needed in El Salvador to house U.S. citizens.

El Salvador is already holding hundreds of people in a maximum-security prison, flown from the U.S. in recent weeks after being detained for allegedly lacking legal status or having gang affiliations.

Critics say many of those individuals were deported with limited or no due process, some in defiance of court orders by U.S. judges.

Responding to Trump on Monday, Bukele suggested his country is prepared to incarcerate American citizens. "Yeah, we've got space," El Salvador's president said.

The proposal has drawn condemnation from some legal scholars, who said it would represent an unprecedented encroachment on the civil liberties of U.S. citizens.

"It's obviously unconstitutional, obviously illegal. There's no authority in any U.S. law to deport U.S. citizens and certainly not to imprison them in a foreign country," said David Bier at the Cato Institute, a libertarian think tank based in Washington, D.C.

"The problem of course is [Trump] already has illegally deported hundreds of people by just not giving the courts an opportunity to stop him," Bier added. "I think that's the real fear now that he is going to try to evade judicial review of deportations of U.S. citizens."

During an appearance Monday on the Fox News show Jessie Waters Primetime, Bondi seemed to embrace it: "These are Americans who he [President Trump] is saying who have committed the most heinous crimes in our country and crime is going to decrease dramatically."

But numerous legal scholars contacted by NPR described the policy idea as crossing a bright line in the U.S. government's treatment of American citizens.

"One hopes that the administration won't go down this path," said Lauren-Brooke Eisen, senior director of the Brennan Center's Justice Program, a progressive think-tank at New York University. "There are profound ethical questions that this move would signal about how we treat human beings who are U.S. citizens. Courts will almost certainly prevent this from happening."

The American Civil Liberties Union has also described the concept as a legal nonstarter:

"You may not deport a U.S. citizen, period," ACLU attorney Lee Gelernt, deputy director of the group's Immigrants' Rights Project, told NPR in February. "The courts have not allowed that, and they would not allow it."

But during a White House press briefing April 8, spokeswoman Karoline Leavitt signaled the proposal is still being seriously considered: "The President has discussed this idea quite a few times publicly, he's also discussed it privately," she said.

"The President has said if it's legal, right? If there is a legal pathway to do that, he's not sure, we are not sure, it's an idea he has simply floated and has discussed," Leavitt added.

Some judges and legal scholars are clearly concerned the Trump administration could move forward with the proposal despite legal and constitutional barriers.

Speaking last week with NPR, Laurence Tribe, a Harvard professor emeritus of constitutional law, offered a similar warning:

"What that means is that literally any of us, whether we are from Venezuela or were born in the United States, whether we are immigrants or not, whether we are citizens or not, any of us is vulnerable to basically being kidnapped by masked agents of the United States government who don't tell us why they're picking us up, perhaps never to be seen again because we're located somewhere in a dungeon, a prison cell, rotting away, whether it's in El Salvador or anywhere else in the world," Tribe said.

The U.S. has incarcerated American citizens before in ways that challenged or violated constitutional norms, including the internment of roughly 120,000 Japanese-Americans during World War II and the detention of Jose Padilla, an American citizen held for years without trial after being accused of terrorism activities in 2002.

But some legal experts interviewed for this story said deporting Americans to serve prison time in foreign countries would cross an alarming new line, effectively stripping U.S. citizens of constitutional and legal protections.

Bier, at the Cato Institute, said he has been "shocked" by the lack of pushback against Trump's proposal from Republican leaders and members of the conservative legal movement.

"It's unthinkable. It's absolutely a reflection of where Donald Trump has taken the Republican Party and the conservative movement," he said.

@Vakarian74 what you and many on this board don't see is how out of touch the dem party is with reality. That's not to say a massive amount of the critiques of Trump and his policies aren't 100% accurate and there isn't some really scary stuff happening. Nothing was accomplished in the last 4 years and a lot got worse. The message of the Dem party right now is TRUMP BAD. That is 90% of the platform. And it isn't wrong. Trump is bad. But the dems aren't doing a thing a about it and screwing up on things like the border. Middle class families who's cost are up 30%.....part of that is Trumps fault but he is 4 years removed and people get paid weekly so memories get short.....don't care about the funding of private institutions their kids have less than a fraction of a percent chance of getting into with $50B in the bank. They don't care enough to donate $5 of their own money if it burned to the ground. They don't care about one guy who came here illegally initially with past gang connections when their local services are strained.... they aren't listening to a party or media that admits they don't have an accurate number for how many crossed, how many died trying, or the whereabouts of 1000s of children that now cares so deeply about one....don't expect an outpouring of empathy for a single person in Maryland when their schools teacher/student ratio changed, housing in their city went up, and wages in their area depressed. Don't expect the masses to understand the legality of a case when this is a board that is connected by the fact we went to a university and only one of us could really speak to the law with any accuracy.....everyone can see a party that acts like this is the end of the world but did nothing for entire term. They don't care if some of DOGE's "findings" are incorrect because some are correct and the totals of those are more then they would make in 1000 lifetimes if you just take 5% of them. Everyone has known for decades about wasteful spending.....doing "something" (didn't say the right thing or method) about it looks better than doing nothing but complaining. The masses aren't going to understand how tarriffs work in two months.....they aren't all going to understand how reckless it is to tariff Canada 25% at 9:00am and 0 at 5:00 pm. The message of "if tariffs are bad why does everyone do it to us" is better to families in swing states that lost manufacturing jobs than "you're blue collar you don't even understand what's happening". The dems entire focus is take down Trump not governing.....it's not a winning message and they are going about it horribly....idiotically bad because they are so out of touch with the rank and file middle class American. And that is no way a statement that Trump gives a single solitary shit about said rank or file or can relate to those people in any way.....but he is working on their overtime and tips not getting taxed and the dems are talking about Harvard losing 4% of what they have in the bank...no one feels sorry for Harvard. It's a loser and will be loser in the mid terms and next presidential election.

A Dem should join DOGE the majority of people like the idea....get involved. Find some things for themselves then criticize cuts that are incorrect or taking a hatchet to employees. Talk about changing massive bills....say "I messed up and voted for this and it needs to be cut but it was buried in a 2000 page bill and I'm going putting forth a bill to stop that".

Pick someone better than Garcia with a sketchy past and complex legal battle to plaster on the news.
