'Disturbing attack': Committee advances bill prohibiting birth certificate sex amendments okcfox
OKLAHOMA CITY, Okla. (KOKH) — On Tuesday, the Oklahoma House General Government Committee advanced a bill that aims to prohibit sex amendments on birth certificates in Oklahoma.
Nicole McAfee, the executive director of the LGBT advocacy group Freedom Oklahoma, asserted the legislation would make an already difficult situation for trans-identifying Oklahomans even worse.
The advocate noted the proposal would bar "anyone ever born in Oklahoma, regardless of where they live now, from having their Oklahoma birth certificate amended to correctly reflect their gender identity... [it's] just an unnecessary and frankly disturbing attack."
State Rep. Kevin West (R-Moore) is pushing back—and argued that his bill clarifies murky questions that can come up in court.
According to him, even if an Oklahoman gets a court order approving such a change, there's no mechanism for the state health department to act on it.
"It's just being open and transparent with the citizens of Oklahoma, giving clear direction to our courts... affirming what the health department already has," he explained.
He added the measure would prevent Oklahomans from going through a lengthy legal process just to get turned down by the health department.
"You get a ruling. You think you've... got this, and then you find out, oh, it's something that the state can't even do," he shared.
According to McAfee, "There are already so many barriers in place for trans folks to get documents that accurately reflect who we are."
In 2022, the Oklahoma governor signed a bill into law preventing the nonbinary "X" designation on birth certificates.
In 2023, the governor also signed a bill into law banning gender transition services for minors.
