A military order is illegal if it violates the Constitution, U.S. laws, or international law, or if it is "patently illegal," meaning a reasonable person would know it directs the commission of a crime. Examples include orders to commit war crimes, torture detainees, or harm civilians. An order can also be unlawful if it is an abuse of authority or for a private, improper purpose.
Categories of illegal orders
Directly criminal: Orders that direct a service member to commit a crime, such as targeting civilians or abusing detainees.
Unconstitutional: Orders that violate the U.S. Constitution.
Illegal under U.S. or international law: Orders that go against U.S. federal law or applicable international law.
Abuse of authority: Orders that are not for a legitimate military purpose, but are used for the commander's private gain or to inflict suffering.
How to determine an illegal order
"Patently illegal" standard: An order is patently illegal if it is so obviously wrong that a person of ordinary sense would recognize it as unlawful under the circumstances.
Examples of patently illegal orders: The intentional targeting of civilians or the torture of detainees are considered classic examples of patently illegal orders.
When in doubt: A service member who receives a questionable order should first try to get clarification from the person who gave the order and should consult with a military defense attorney.
Consequences of disobeying an order
Lawful orders: Service members are required to obey all lawful orders.
Unlawful orders: Refusing a patently illegal order is a duty, not an offense.
Consequences for unlawful orders: Both the person giving an unlawful order and the one who carries it out can face legal consequences.
